Who is obligated in Finland
Finland split the EAA across two statutes rather than one omnibus law. The Act on Accessibility Requirements for Certain Products (102/2023) covers the EAA hardware list: consumer general-purpose computers and operating systems, payment terminals, self-service terminals (ATMs, ticket and check-in machines, interactive information points), consumer terminal equipment for electronic communications and audiovisual media access, and e-readers. A new chapter inserted into the pre-existing Digital Services Act (306/2019) covers the EAA service list — e-commerce, e-books, consumer banking, payment, investment and insurance services, transport passenger information, and audiovisual/electronic-communications access services. Both instruments bind any manufacturer, importer, distributor or service provider reaching Finnish consumers, regardless of establishment. The standard EU microenterprise exemption (under 10 staff, turnover or balance sheet under €2 million) excuses microenterprises from the service rules only, never product obligations.
What happens if you don't comply
Traficom does not pre-certify products or services; enforcement starts from complaints or its own market checks — it inspected nearly 900 digital services for accessibility between 2020 and 2024 under the law's public-sector-derived predecessor regime. Under the products act, if Traficom finds a formal defect such as a missing or incorrect CE marking, it must first require the trader to correct it; continued non-compliance triggers restriction, a market-access ban, or a forced withdrawal. Under the services chapter, Traficom similarly issues a corrective order with a reasonable deadline before anything else happens. Only if that order — or a request for information or inspection — is ignored can Traficom attach an uhkasakko to compel compliance; this coerces future action rather than punishing the original breach. Separately, deliberate CE-mark misuse is a criminal offence prosecuted through the ordinary courts. Traficom has also used a softer formal reprimand for accessibility shortfalls in some cases, such as against a TV broadcaster over subtitle quality.
How this differs from the EU baseline
Finland's most distinctive choice is institutional consolidation: rather than splitting EAA enforcement across sector regulators the way Denmark or Sweden do, Finland routes products, e-commerce, e-books, transport information, and consumer banking, insurance and investment services through one authority, Traficom, which absorbed the remaining piece of digital-service oversight from a regional agency on 1 January 2025. Substantively, Finland also avoids any fixed penalty figure: both tracks rely on an uncapped, case-by-case conditional fine that only bites if a trader ignores a prior corrective order, rather than a direct sanction for the violation itself. Finland also folded its new private-sector service rules into a pre-existing public-sector web-accessibility law instead of legislating services separately.
