Administrative fines under Government Decree 605/2022 (XII.28.) Section 9 start at HUF 15,000. For operators that are not SMEs and have annual net revenue above HUF 100 million, the ceiling is 5% of annual net revenue, capped at HUF 500 million. For other operators the ceiling is HUF 500,000, rising to 5% of annual net revenue where the breach endangers the physical safety or health of a wide range of consumers or causes them significant financial harm. These are HUF figures and revenue percentages, not fixed euro amounts; at the Magyar Nemzeti Bank's middle rate of about 363 HUF/EUR (31 July 2026), HUF 500 million is roughly €1.38 million, illustrative only, as the forint floats.

Who is obligated in Hungary

Hungary transposed the EAA through Act XVII of 2022, which entered into force on 2025-06-28 together with its implementing Government Decree 605/2022 (XII.28.). It covers the full EU-mandated product list — computers and operating systems, smartphones and other consumer terminal equipment for electronic communications, e-readers, self-service terminals such as ATMs, ticketing and check-in machines, and payment terminals — plus the matching services: e-commerce, banking, e-books, electronic communications, audiovisual media access services, and passenger transport information. A national wrinkle: self-service terminals lawfully in use before the law's application date may stay in service for their full economic life, capped at 20 years from installation, service contracts concluded before the law applied may run unchanged until they expire, at the latest 2030-06-28, and until that date services may still be delivered using non-compliant products that were lawfully in use before (Section 12). The standard EU microenterprise exemption applies — businesses with fewer than 10 staff and under €2 million in annual turnover or balance sheet are exempt from the accessibility requirements for the services they provide (Section 3(3)), though even micro manufacturers of physical products still get only a lighter documentation burden, not a full product exemption.

What happens if you don't comply

Enforcement runs through the category-specific 'ellenőrző hatóság' (controlling authority) named in Decree 605/2022: NMHH for most electronic-communications and media-related products and services, the national consumer protection authority (NKFH) for payment terminals and other listed products, the Magyar Nemzeti Bank for banking self-service terminals, and transport authorities for passenger-transport information. Under Section 8 of Act XVII, the controlling authority can order corrective measures — bringing a product or service into compliance within a set deadline, restricting or prohibiting market placement, and ordering withdrawal or recall — before or alongside imposing a fine; the law is built on the existing product-safety market-surveillance framework (Act LXXXVIII of 2012), not a criminal process. How this differs from the EU baseline

What's distinctive is the four-way enforcement split rather than a single coordinator: NMHH, the consumer protection authority (NKFH), the central bank (MNB), and sector transport authorities each police their own slice of the product/service list under one implementing decree (605/2022), rather than one agency handling everything as in Austria. The penalty design is also notably scaled: instead of a flat euro ceiling, Hungary sets a HUF floor as low as 15,000 for minor cases involving small operators, but ties the ceiling for large companies to 5% of annual net revenue, capped at HUF 500 million — a revenue-linked mechanism closer to GDPR-style fining than to most peers' fixed caps. On transition, Hungary uses the Directive's own Article 32 windows rather than extending them: the 20-year allowance for self-service terminals already installed is the option Article 32(2) lets member states choose, and the 2030-06-28 end date and five-year cap on pre-existing contracts are the limits Article 32(1) sets for every member state.
